The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

10. Applicable Law and Dispute
This Agreement and all matters arising from it are governed by and construed in accordance with the laws of The United States of Americawhose courts shall have exclusive jurisdiction over all disputes arising in connection with this Agreement and the place of performance of this Agreement is agreed by you to be The United States of America.

11. Headings
Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this Agreement.

12. Royalities
Crossroads Media LLC. WILL NOT pay any royalties or income to any submitted material or material given with verbal or written permission to the licensors, employees, or volenteers of Crossroads Media LLC.

13. On Air Advertising Agreements
On Air Advertising Agreements will be contracted via meetings, mail, or fax and NOT online.

14. Cost Per Click Advertising (CPC)
This advertising method was created for businesses, personal, myspace, facebook, non profit, orginizations, etc. websites not including porn or illegal activity. Those ads will be terminated upon discovery.

15. Entire Agreement
These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.

16. Submitted Content
Any and all content submitted or posted by any user to www.radionocturnal.net, www.radionocturnaladnet.com, www.videonocturnal.com or www.treubigshow.com is property of Crossroads Media LLC. We may use the submitted material for any purpose.

17. Payments
If a payment from Crossroads Media LLC. to a Publisher on www.radionocturnaladnet.com or company or musician performing a service or non-service for Crossroads Media LLC. will result in a minimum of a $100.00 payment. All payments issued the first seven days of the month if required. We have right to deny any payment at any time without notice. All legal and tax documents must be completed before payment is issued.

Cash or Personal checks with Bankers Card, all major Credit/Debit Cards, Bankers Draft or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full within thirty days. All goods remain the property of the Company until paid for in full. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the  base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed $3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Returned checks will incur a $35 charge to cover banking fees and administrative costs. In an instance of a second Returned checks, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

We may terminate any advertising or service immeditly for non-payment or returned check. We may resume services when fees and funds are paid in full.
